FACTS:

Our client was driving a motorcyclist westbound on Interstate 70 when the Defendant-Driver negligently let loose wet mud, rock, and debris from his municipally-owned dump-truck.

INJURY:

The debris on the highway caused the motorcycle to crash into the dividing barrier. Because of the accident, our client was admitted for treatment during a 4-day hospitalization.

He suffered left wrist fractures, right clavicle fracture, and 5 rib fractures. He returned to the hospital for surgery, where he underwent internal fixation of his right clavicle where the orthopedic surgeon surgically implanted 2 plates and 6 screws into his right collar bone because of the severity of the injury.

DEFENDANTS DENIED LIABILITY:

Defendants denied liability. We alleged that defendants failed to load and secure their vehicle so as to keep their load safely within the confines of the Defendants’ vehicle. Defendants countered that even if they were liable, the plaintiff was traveling to fast for conditions, too close for safety, and wore improper safety equipment.

STATUTORY IMMUNITY:

Municipal corporations enjoy sovereign immunity protection pursuant to Missouri Statute 537.600.1. Because of this statute, municipal corporations are immune from some claims and other claims are statutorily capped.

SETTLEMENT: $375,000
