ACTION PLAN AFTER AN AUTO ACCIDENTS

Keep an Emergency Kit in Your Trunk or Glove Compartment. Drivers should carry a cell phone, as well as a pen and paper for taking notes, a disposable camera to take photos of the vehicle at the scene, and a card with information about medical allergies or conditions.  A set of cones, triangles or emergency flares should be kept in the trunk.

Keep Safety First. Drivers involved in minor accidents with no serious injuries should move cars to the side of the road out of the way of oncoming traffic. If a car cannot be moved, drivers and passengers should remain in the car with seatbelts fastened for everyone’s safety until help arrives. Make sure to turn on hazard lights and set out cones, flares or warning triangles if possible.

Assess and Get Help

First steps after impact are:

  • Put on your emergency flashers so other drivers will go around you.
  • Check to see if anyone in your car is injured, and if so, call for medical help.
  • Exit your vehicle if it’s safe and you’re physically able to do so.
  • Check to see if anyone in the other vehicle is injured, and if so, call for medical help.
  • Call the police. An officer will make a police report of the facts of the accident, which can be used in insurance investigations and lawsuits.
  • Take a picture of the scene if you have a camera. Some people keep a disposable camera in their car for this reason. You also may have a camera on your cell phone.
  • File a Car Accident Report with the Police. Even in a minor accident it is important to make sure there is a legal accident report. Do not leave the scene without doing so.

Discuss the Car Accident Only with the Police. With everyone all shook up it can be hard not to talk about what just happened, but that can also lead to misstatements about what happened. It is important to limit your discussions about the accident.

Get the Facts. This is the part most people know to do, but often forget to after the accident for one reason or another. Get phone numbers of everyone involved in the accident. Get a description of the car and license plate information and their insurance company and the vehicle identification number of their car.

Call Your Insurance Agent. Call your agent or insurance company’s 800-number immediately, even at the scene with the police if possible.

Get Medical Treatment Immediately. If your injuries are serious, allow the police, fire department or ambulance to transport you to the nearest hospital. If you do not require an ambulance, you should seek medical treatment as soon as possible at the emergency room, local medical center, or at your family doctor. When talking to the doctor or nurses, provide an accurate description of how you were injured in the accident and explain all the injuries you sustained.

Preserve Important Evidence. If you have any visible injuries such as bruises, lacerations, stitches, or any other visible evidence of injury, photograph them. Also, take pictures or your car, the other cars and, if possible, any other evidence you can photograph such as skid marks and location of debris on the roadway.

Do Not Sign Any Documents or Allow Anyone to Record You. You have no obligation to provide a written or recorded statement to anyone immediately and you should not do so. You never have an obligation to give a recorded statement to the other driver’s insurance company. You may be required to give a recorded statement to your own insurance company but you should not do so without first consulting with an attorney specializing in personal injury litigation.

If Your Injuries Persist, Get Follow-Up Medical Care. In the unfortunate event that your injuries last more than a few days, seek follow-up medical care with a doctor. When talking to your doctor or therapist, it’s important to provide accurate descriptions of your injuries as well as the severity and frequency of your symptoms.
